Terms of Service

1. Agreement to Terms

By accessing or using CoolVDS services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Acceptable Use Policy

2.1 Permitted Use

Our services may be used for:

• Legitimate business applications
• Personal websites and projects
• AI/ML training and inference
• Game server hosting
• CI/CD pipelines and development
• Legal content hosting

2.2 Prohibited Activities

3. Account Responsibilities

• You are responsible for maintaining account security
• Use strong passwords and enable two-factor authentication
• Notify us immediately of unauthorized access
• You are liable for all activity under your account
• One account per person/organization

4. Service Level Agreement (SLA)

4.1 Uptime Guarantee

We guarantee 99.9% uptime for infrastructure services (excluding scheduled maintenance).

4.2 Scheduled Maintenance

Scheduled maintenance will be announced at least 48 hours in advance. Emergency maintenance may occur with minimal notice.

4.3 SLA Credits

If uptime falls below 99.9%, you may be eligible for service credits:

• 99.0% - 99.9%: 10% credit
• 95.0% - 98.9%: 25% credit
• Below 95.0%: 50% credit

5. Billing and Payment

5.1 Pricing

All prices are listed in USD. Prices are subject to change with 30 days notice.

5.2 Payment Terms

• Services are billed monthly in advance
• Payment is due upon invoice
• Late payments may result in service suspension
• We accept credit cards (Visa, Mastercard, Amex)

5.3 Refund Policy

30-day money-back guarantee for new customers. Pro-rated refunds available for service failures covered by SLA.

6. Data and Backups

6.1 Your Responsibility

You are responsible for backing up your data. While we provide infrastructure reliability, we are not liable for data loss.

6.2 Backup Services

Optional backup services are available. Game server packages include automatic daily backups with 30-day retention.

7. Intellectual Property

7.1 Your Content

You retain all rights to your content. By using our services, you grant us permission to host and deliver your content.

7.2 Our Property

CoolVDS name, logo, and infrastructure technology remain our property. Unauthorized use is prohibited.

8. Termination

8.1 By You

You may cancel your account at any time through the control panel. Cancellation takes effect at the end of the billing period.

8.2 By Us

We may suspend or terminate services for:

• Violation of these Terms
• Non-payment
• Illegal activity
• Abuse affecting other users

9. Limitation of Liability

To the maximum extent permitted by law:

• Services are provided "as is" without warranties
• We are not liable for indirect or consequential damages
• Total liability is limited to fees paid in the last 12 months
• We are not responsible for third-party services or content

10. Privacy and GDPR

Our Privacy Policy governs how we collect and use your data. We comply with GDPR, CCPA, and Norwegian privacy laws.

11. Governing Law

These Terms are governed by Norwegian law. Disputes will be resolved in Norwegian courts.

12. Changes to Terms

We may modify these Terms with 30 days notice via email. Continued use constitutes acceptance of new terms.
